Landlord Electrical Safety: What You Need to Know

Landlords in England have clear legal obligations around electrical safety. Failing to comply can result in fines of up to £30,000 and invalidate your landlord insurance. Here is a clear guide to what is required.

The Electrical Safety Standards Regulations 2020

Since 1 April 2021, all private landlords in England must:

• ⚡Have the electrical installation inspected and tested by a qualified electrician at least every 5 years
• ⚡Obtain an EICR (Electrical Installation Condition Report)
• ⚡Provide a copy of the EICR to existing tenants within 28 days of the inspection
• ⚡Provide a copy to new tenants before they move in
• ⚡Provide a copy to prospective tenants within 28 days of a written request
• ⚡Carry out any remedial work identified within 28 days (or sooner if specified)

Smoke and CO alarms

Under the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022, landlords must:

• ⚡Install a smoke alarm on every storey of the property
• ⚡Install a CO alarm in any room with a fixed combustion appliance (including gas boilers)
• ⚡Ensure alarms are in working order at the start of each tenancy

What qualifies as a "qualified electrician"?

The regulations require inspections to be carried out by a "qualified person" — in practice, this means an electrician registered with a competent person scheme such as NICEIC. Always ask for evidence of registration before booking.

What if the EICR fails?

If the EICR identifies C1 or C2 issues, remedial work must be completed within 28 days. You must provide written confirmation of the completed work to your tenants and retain records for at least 2 years.
